Hypothetical Assignment

As your last assignment at the United States Circuit Court of Appeals, your justice has asked you to investigate a possible legislative history issue on a case the court will be hearing in the coming months.

The case involves the appeal of an attorney who was denied a license by the state bar because of a history of depression. The attorney brought suit against the state bar under Title II of the Americans with Disabilities’ Act of 1990 and the U.S. Constitution.

Your justice vaguely remembers a recent case, within the last two years, with similar facts in the Ninth Circuit that involved a doctor rather than a lawyer. While she recalls that the previous case was denied cert by the Supreme Court, she was struck by the number of Amici Curiae that referenced the legislative history of Title II.

She has asked you to:

1) Retrieve the most explicative Amici Curiae from the previous case.

2) Retrieve the full text of the bills that effected Title II of the Americans with Disabilities’ Act of 1990.
